1. About these terms
These Terms & Conditions apply to enquiries and bookings made with Escape to Wildlife Safaris Ltd (“we”, “us”, or “our”). They should be read together with your written quotation, itinerary, booking confirmation, invoice, and our Privacy Policy.
A written quotation or booking confirmation may contain trip-specific conditions. If a trip-specific condition conflicts with these general terms, the trip-specific written condition will apply to that booking, subject to mandatory law.
2. Quotations, acceptance, and booking
Website descriptions and sample itineraries are invitations to enquire and are not binding offers. A contract is formed only when we have issued a written quotation or booking confirmation, you have accepted it, and we have received the required deposit or otherwise confirmed the booking in writing.
The person making the booking confirms that they are at least 18 years old, are authorised to act for everyone named in the booking, and will communicate these terms and all booking information to them.
Availability remains subject to confirmation by lodges, transport operators, park authorities, and other suppliers. Please check names, dates, services, and traveller details promptly and notify us of any error.
3. Prices, deposit, and payment
Your written quotation will state the price, currency, included services, excluded services, payment method, and any trip-specific payment deadline. Unless the written confirmation states otherwise, a deposit of 30% of the confirmed price is required to secure the booking and the balance is due on arrival.
Bank, card, transfer, exchange-rate, or intermediary charges are the traveller’s responsibility unless we expressly include them. Failure to pay an amount when due may allow us to suspend or cancel unconfirmed services after giving reasonable notice.
Prices may change before a booking is confirmed. After confirmation, a price will change only where the booking terms permit it or where taxes, park fees, government charges, exchange conditions, or requested services change. We will explain any proposed adjustment before collecting the affected balance.
4. Changes, cancellations, and refunds
Changes or cancellation by the traveller
Requests must be sent to us in writing. We will try to accommodate a requested change, but availability and additional supplier costs may apply. A name change may be treated as a cancellation and new booking where a supplier does not permit transfer.
Cancellation charges and refund eligibility are determined by the written quotation or booking confirmation, amounts already paid or committed to suppliers, and the cancellation terms of the affected lodges, transport operators, park authorities, and other providers. We will identify material non-recoverable costs and return any amount that is refundable after those costs and any expressly agreed administration charge.
Changes or cancellation by us
Safari travel may require reasonable changes because of weather, road conditions, wildlife movements, park rules, safety concerns, supplier changes, or events outside our reasonable control. Where a material service becomes unavailable, we will seek a reasonably comparable alternative and inform you as soon as practicable.
If we cancel a material part of the trip and cannot provide a reasonable alternative, we will offer an appropriate refund of amounts received for the affected service that remain recoverable, subject to applicable law. We are not responsible for independent arrangements that were not booked through us.
5. Traveller responsibilities
Each traveller is responsible for:
- valid passports, visas, permits, vaccinations, health requirements, and entry or exit rules;
- providing accurate names, contact details, travel dates, health or accessibility information relevant to the requested services;
- arriving at agreed meeting points and departures on time;
- following applicable laws, park rules, accommodation rules, and reasonable safety instructions from guides and suppliers;
- obtaining suitable travel insurance for cancellation, medical treatment, evacuation, baggage, and activities included in the itinerary.
We may refuse or discontinue a service where a traveller’s conduct creates a material safety risk, seriously disrupts others, damages property, or breaches applicable law. Any decision will be made reasonably in the circumstances.
6. Safari conditions, health, and third-party suppliers
Safaris, mountain activities, road travel, marine activities, and visits to remote areas involve inherent risks. Conditions may include wildlife, uneven terrain, altitude, weather, limited medical access, long drives, dust, and changing road or park conditions. Wildlife sightings and specific natural events cannot be guaranteed.
Tell us before booking about mobility, accessibility, dietary, medical, or other needs that may affect the trip. We will discuss reasonable arrangements but cannot guarantee that every destination or third-party facility can meet every requirement.
We arrange services from independent lodges, airlines, transfer providers, park authorities, and other suppliers. Their own conditions may apply to the services they provide. We will exercise reasonable care in selecting and coordinating suppliers but do not control every act, omission, schedule, or facility of an independent provider.
7. Responsibility and liability
We are responsible for providing the services we directly control with reasonable care and skill and for coordinating the confirmed itinerary. To the extent permitted by law, we are not liable for losses caused by the traveller, an unrelated third party, inaccurate information supplied to us, or extraordinary events outside our reasonable control that could not reasonably have been avoided.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence where applicable. Any limitation is also subject to the mandatory rights available to the traveller under applicable law.
8. Problems, complaints, and governing law
Raise a problem with the guide or our contact person as soon as possible so we have a reasonable opportunity to address it during the trip. If it is not resolved, send a written complaint with relevant details to info@escapetowildlifesafaris.com as soon as reasonably practicable.
We will first try to resolve disputes through good-faith discussion. These terms and bookings with us are governed by the laws of the United Republic of Tanzania, and unresolved disputes are subject to the competent courts of Tanzania, unless mandatory law requires otherwise.
9. Privacy, changes to these terms, and contact
We handle personal information as described in our Privacy Policy. We may update these general terms for future enquiries and bookings. The version accepted when a booking is confirmed will continue to apply to that booking unless a lawful written amendment is agreed.
